Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and EyeStream Visions Inc. ("EyeStream," "we," "us") governing your use of the EyeStream Visions website and services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old (or the age of majority in your jurisdiction, if higher) and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. Your account

You are responsible for keeping your login credentials confidential and for all activity under your account. Provide accurate information and keep it current. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

3. Your content

"User Content" means anything you submit, including videos, audio, your image and likeness, résumés, profile details, and messages. You retain ownership of your User Content.

You grant EyeStream a worldwide, non‑exclusive, royalty‑free license to host, store, reproduce, transcode, adapt (e.g. format for cross‑browser playback), and display your User Content solely to operate and provide the Service. When you publish or share a Vision, you also authorize us to make it available to the recruiters, hiring teams, and other viewers you choose (including recipients of links/QR codes and colleagues a recruiter forwards it to). This license ends when you delete the content or your account, except for content already shared and for reasonable backup retention.

You represent that you have the rights to your User Content and that it does not infringe others' rights or any law.

4. Acceptable use

You agree not to:

• Post unlawful, defamatory, harassing, hateful, deceptive, or infringing content;
• Impersonate anyone or misrepresent your identity, experience, or affiliation;
• Upload anyone else's image, voice, or personal information without their consent;
• Attempt to gain unauthorized access to the Service, other accounts, or our systems; probe, scan, scrape, or test security without permission;
• Introduce malware, overload, or otherwise interfere with the Service;
• Use the Service to send spam or for any purpose other than legitimate job‑seeking or recruiting.

Reporting and moderation. Every Vision page has a "Report this Vision" link — you don't need an account to use it. We review reports and may unpublish content, suspend accounts, or remove material that violates these Terms, at our discretion and without prior notice. If you believe content impersonates you or uses your image without consent, report it or email us and we will prioritize the review.

5. Recruiter and hiring‑team obligations

If you access candidate information, you agree to use it only for legitimate recruiting and hiring purposes, to handle it in compliance with applicable employment, anti‑discrimination, and data‑protection laws, not to redistribute it beyond your hiring team and your own applicant‑tracking system, and not to make hiring decisions in any unlawful manner. Exported candidate profiles (PDF or ATS email) remain subject to these obligations. You are responsible for your own compliance with all laws applicable to your hiring activities, including any laws governing automated employment‑decision tools — noting that EyeStream's matching is deterministic and evidence‑quoted, and its AI never scores or ranks candidates autonomously.

6. Subscriptions and billing

The Service may offer free and paid tiers. During early access, recruiter tiers are provided free of charge and no payment is required. If we introduce paid subscriptions, the applicable price, billing cycle, and terms will be presented at purchase, payments will be processed by our payment processor, and fees are non‑refundable except as required by law or expressly stated. We may change pricing prospectively with notice.

7. Intellectual property

The Service, including its software, design, logos, and content (excluding User Content), is owned by EyeStream and protected by intellectual‑property laws. We grant you a limited, revocable, non‑transferable license to use the Service per these Terms. You may not copy, modify, or create derivative works of the Service except as permitted.

8. Third‑party services

The Service relies on third‑party providers (e.g. hosting, email, AI processing, payment). We are not responsible for third‑party services, and your use of them may be subject to their terms.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not guarantee that the Service will be uninterrupted, secure, or error‑free, or that using it will result in any job, interview, hire, or particular outcome.

10. Limitation of liability

To the maximum extent permitted by law, EyeStream and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us in the 12 months before the claim or US $100.

11. Indemnification

You agree to indemnify and hold EyeStream harmless from claims, damages, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms or any law or third‑party right.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service or its users. Sections that by their nature should survive termination (e.g. content license for already‑shared content, disclaimers, limitation of liability, indemnification) will survive.

13. Governing law and disputes

These Terms are governed by the laws of [State/Country], without regard to conflict‑of‑laws rules. The courts located in [Jurisdiction] will have exclusive jurisdiction, unless applicable law gives you the right to bring a claim elsewhere.

14. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here with a new "Last updated" date and, where appropriate, notify you. Continued use after changes take effect means you accept them.
